La jurisprudencia Deggendorf como medio de forzar la recuperación de las ayudas ilegales.

Resumen
La desobediencia por el Estado de una decisión de recuperación de una ayuda ilegal obliga a la Comisión a recurrir ese incumplimiento ante el Tribunal de Justicia. Así, la distorsión de la competencia que supone la ayuda ilegal se prolonga durante el tiempo que dure ese procedimiento. La jurisprudencia Deggendorf fuerza la recuperación de ayudas ilegales, pues en su virtud la Comisión puede suspender el pago de una ayuda a una empresa con una orden de recuperación pendiente de ejecutar. La Comisión ha extendido el ámbito de esta jurisprudencia a empresas distintas de la obligada a restituir una
ayuda, pero pertenecientes a la misma «unidad económica», cuestión sobre la que deberá pronunciarse el Tribunal de Primera Instancia, cabe esperar que confirmando este enfoque. Además, la Comisión está incluyendo tal jurisprudencia en los impresos de notificación de nuevas ayudas, en las decisiones de autorización de regímenes de ayuda y en las nuevas normas sobre ayudas. En el lado negativo, este principio se aplica a veces sin verdadera motivación. La parte más positiva es que favorece la credibilidad de la política de ayudas.

Abstract
The lack of compliance with a recovery decision on illegal aid forces the Commission to bring the matter before the European Court of Justice. Therefore, the distortion of the competition that the illegal aid constitutes carries on during the development of that proceeding. The Deggendorf principle forces the recovery of illegal aid because, according to it, the Commission may suspend the payment of an aid to a company with a pending recovery decision. The Commission has extended the scope of said judgement to entities other than the beneficiary of aid in cases where the beneficiary of new aid belongs to the same «economic unit». The case is pending before the Court of First Instance, which may probably confirm the scope of the Commission. In addition, the Commission is including said principle in the new notification forms; in the decisions approving new aid schemes and in new legislative texts. The negative part of this principle is that it is applied, sometimes, without real motivation. The main positive aspect is that it reinforces the State aid policy.
