Resumen
En el presente estudio se analiza el derecho a la protección de datos de carácter personal
desde su regulación en el Tratado por el que se instituye una Constitución para Europa,
partiendo del déficit provocado por la ausencia de un catálogo de derechos fundamentales
en el ámbito comunitario. La indisoluble vinculación de este derecho con el derecho a la
intimidad ha generado dos líneas jurisprudenciales diversas emanadas desde el Tribunal
Europeo de Derechos Humanos y desde el Tribunal de Justicia, la primera favorable a su
inclusión en el derecho a la intimidad y la segunda a una concepción autónoma del mismo;
línea por la que también se decanta el Tratado. La divergencia de esta última postura
pretende justificarse a través del análisis jurisprudencial y de la regulación en el Tratado
de este nuevo derecho.

Abstract
This study analyzes the regulation of the protection of personal data right in the Treaty
establishing a Constitution for Europe, taking as starting point the deficit caused by the
absence of a fundamental right catalogue in European area. The close link between this
right and the privacy right has produced two different jurisprudencial visions. The
European Court of Human Rights conceives the protection of personal data right as a
manifestation of privacy right; instead of this, for the Court of Justice of the European
Communities is a specific right. This one is the option taken by the Treaty too. The
disagreement with this position is justified by this study through the analysis of the
jurisprudence and the Treaty regulation of this new right.
