Resumen
Los posicionamientos doctrinales sobre la naturaleza del concepto de servicio esencial se
han situado básicamente entre la consideración de éste como cláusula general, como concepto
abierto o estándar jurídico-político y su consideración como concepto jurídico indeterminado.
Siguiendo esta última concepción, los problemas interpretativos se han suscitado
en torno a qué entender por concepto jurídico indeterminado. Más en concreto y en relación
a su inclusión en nuestro texto constitucional, la problemática se suscita en la concreción
y desarrollo de dichos conceptos por el legislador y en su controvertido control
por los jueces. Desde la consideración de los conceptos jurídicos indeterminados como
«expresión por juicios disyuntivos» a su consideración como susceptibles de valoraciones
e interpretaciones diversas, se analiza en el presente estudio el complejo alcance y control
del contenido de la noción constitucional de «servicio esencial».

Abstract
The doctrinal postures relating to the concept of essential utility have been oscillating
principally between its consideration as a general clause, as an open concept or a political
and legal standard, and its consideration as an undetermined legal concept. According to this
latter conception, the interpretation problems are limited to the meaning of undetermined
legal concepts. More precisely, in the context of our Constitution, the more significant
difficulties reside in the definition and determination of this concepts by the legislator and
in its controversial control by the judge. From its consideration as an «expression with
disjunctive opinions» to its consideration as a possible object of different interpretations and valorizations, this article analyses the intricated scope and the arduous control of the
constitutional concept of «essential utility»
