Resumen
El menor tiene derecho a ser oído en los procesos matrimoniales que le
afecten. Este derecho, recogido en distintos textos legales, cambia su configuración
y alcance tras la Ley 15/2005, de 8 de julio, que modifica la normativa
sobre separación y divorcio. El presente artículo examina el régimen jurídico
actual del derecho de audiencia del menor, tomando en consideración
las novedades introducidas por la Ley 15/2005 y la reciente Ley
13/2009. Asimismo, se analizan en detalle las últimas sentencias del Tribunal
Constitucional sobre el particular (SSTC 17/2006, 22/2008 y 163/2009).

Abstract
The minors have the right to be heard in the matrimonial processes in
which they are involved. This right, included in different legal texts,
changes its configuration and scope after the 15/2005 Act, dated 8 July,
which modifies the regulation on separation and divorce. This article
reviews the current legal system regarding the minors’ right to be heard,
taking into consideration the novelties implemented by the 15/2005 Act
and the recent 13/2009 Act. Likewise, this article analyses in detail the last
judgments of the Constitucional Court on this matter (SSTC 17/2006,
22/2008 and 163/2009).
