Una reforma electoral posible: el voto de la diáspora vasca

Resumen
Se aborda en este artículo la posibilidad de que los ciudadanos que, provenientes del País Vasco y Navarra, hayan tenido que cambiar de domicilio a otro lugar de España como consecuencia de la presión terrorista de ETA y organizaciones afines puedan votar en sus circunscripciones de origen sin tener que volver físicamente a ellas. La respuesta es positiva a partir de las líneas generales de la jurisprudencia tanto del Tribunal Europeo de Derechos Humanos como del Tribunal Constitucional, si bien ninguno de ellos ha resuelto casos análogos. Por otro lado, también se analiza a qué tipo de procesos puede extenderse el reconocimiento de tal derecho, aspecto en el que se propone la inclusión de todos los comicios, solución constitucionalmente posible y más cómoda y operativa para el elector. Finalmente, se presenta una propuesta para su articulación jurídica que pretende ser lo más sencilla posible, definiendo quiénes pueden acogerse a esta opción, a través de un procedimiento temporal que no altere el sistema de actualización ordinaria del censo y se eviten riesgos de votos dobles.

Abstract
The purpose of this article is to study the possibility for citizens who, coming from the Basque Country and Navarra, have been forced to change their domicile to another place in Spain due to ETA terrorist pressure and related organizations, to vote in their constituencies of origin without having to return to them physically. The answer is positive according to the general lines of case law both of the European Court of Human Rights and the Constitutional Court, while none of them has solved similar cases. In addition, we analyze what kind of processes the recognition of that right can be extended to. In this regard we propose the inclusion of all elections, solution constitutionally possible and more comfortable and operational for the voter. Finally, we present a proposal for a statutory regulation, intended to be as simple as possible, defining who can benefit from this option, through a temporary procedure that does not alter the system of regular updating of the census and avoid risks of double votes.
