La esencia de la definición del patrimonio cultural inmaterial: su elemento subjetivo

Resumen
Determinar qué manifestaciones son susceptibles de incluirse en el patrimonio cultural inmaterial requiere la conjugación de diversos elementos, de los que resultan fundamentales los referidos a su carácter vivo, representativo, contextual, relacionado en ocasiones con bienes materiales y, en todo caso, vinculado a una comunidad portadora que lo reconoce como propio, lo preserva y lo transmite. Como se ve, ninguna de estas características se puede definir de forma sencilla, puesto que todas ellas presentan cierto grado de discrecionalidad. Este es el motivo por el que, más allá de las amplias definiciones positivas contenidas en los textos normativos aplicables, se propone una definición del patrimonio cultural inmaterial con especial primacía de su elemento subjetivo.

Abstract
Determining which manifestations are susceptible to being included in the intangible cultural heritage requires the combination of various elements, of which those referring to its living, representative, contextual character, sometimes related to material goods and, in any case, linked to a community that recognizes it as its own, preserves it and transmits it, are fundamental. As can be seen, none of these characteristics can be easily defined, since all of them present a certain degree of discretion. That is why, beyond the broad positive definitions contained in the applicable normative texts, a definition of intangible cultural heritage is proposed with particular emphasis on its subjective element.
