Resumen
La creciente preocupación por el dopaje en el deporte, tanto por el grave riesgo que representa
para la salud pública e individual como para la desvirtuación de la competición, ha
llevado a una progresiva publificación en la lucha contra el dopaje dentro de la clásica intervención
pública sobre el deporte, sumándose a la ya compleja trama organizativa del deporte
internacional. La Convención de la UNESCO contra el Dopaje en el Deporte, ratificada
por España y en vigor desde febrero de 2007, es el mejor ejemplo de este protagonismo
del Derecho internacional público y consiguiente armonización internacional en la materia,
en sintonía con el Código Mundial Antidopaje, cuyos principios y estándares técnicos son
incorporados con naturaleza vinculante. Un privilegiado contexto internacional y de Derecho
comparado donde hace su aparición la Ley Orgánica 7/2006, de 21 de noviembre, fruto
de la decidida voluntad del legislador español por afrontar desde una perspectiva integral y
armonizada los continuos retos de dichas prácticas. En un esfuerzo por ordenar los distintos
aspectos que integran el universo del dopaje, el presente trabajo se centra en la dimensión nacional y administrativa del fenómeno, glosando con carácter crítico las importantes
reformas introducidas por el nuevo diseño legal.

Abstract
The growing preoccupation with doping in sport, not only for the serious risk that it poses
to public and individual health but also for the distorting of competition, has led to an everincreasing
publification of the fight against doping within the frame of a classical public
intervention in sport, joining in the already complex organizing scheme of international
sport. The UNESCO International Convention against Doping in Sport, ratified by Spain
and into force since February 2007, is the best example of this protagonism of Public
International Law and the resulting international harmonization of control procedures in
tune with the World Anti Doping Code, whose principles and technical standards are
assimilated with a binding nature. A priviledge international context and comparative Law
where the Organic Law 7/2006 appears, on the 21st November, fruit of the Spanish
legislator’s resolute will to face the constant challenges of such practices from an integral
and armonized perspective. In an effort to order the different aspects which compose the
doping universe, the current article focuses on the national and administrative dimension
of this phenomenun, glossing with a critic character the important reforms introduced by
the new legal design.
