Resumen
El estudio sitúa el ámbito de justificación tradicional de la institución del indulto en la idea de soberanía y en dos de sus atributos esenciales: la gracia y la justicia.

Ambas nociones están en oposición en el contexto penal por el carácter esencialmente inmotivado de la gracia, que, al igual que la misma noción de soberanía sobre la que se asienta, parece estar en abierto conflicto con exigencias básicas del Estado de derecho. El estudio aborda también la ambigua noción de excepcionalidad,

que puede ser entendida como extraordinariedad o como excepción, para analizar la noción de generalidad en los indultos y para concluir defendiendo la necesidad y la posibilidad de una regulación legal limitativa, y especialmente restrictiva, del derecho de gracia.

Abstract
The essay situates the field of traditional justification of pardon in the idea of sovereignty and in two essential attributes of that idea: mercy and justice. These two notions are in opposition in a criminal context due to the essentially motiveless character of mercy, which, as the notion of sovereignty that supports it, seems to be in open conflict with the most basic requirements of the rule of law. The study also deals with the ambiguous notion of exceptionality, which can be understood either as extraordinarity or as exception, in order to analyse the notion of generality in pardons and to conclude defending the need and the possibility of a limitative and specially restrictive legal regulation of the right of pardon.
