Resumen
La renuncia al derecho de propiedad no ha sido un tema especialmente estudiado. Siempre se ha estimado que existiendo voluntad de abandono y la desafección física entre el propietario y el bien era suficiente para considerar el bien res nullius. Sin embargo, la compleja configuración del derecho de propiedad, la variedad de objetos sobre los que recae y, sobre todo, su función social matizan de modo importante el ejercicio de la facultad de renuncia. Si a esto se le añade que la renuncia no puede hacerse en perjuicio de tercero, la consecuencia es que en muchos casos debe considerarse a la propiedad como un derecho irrenunciable.

Abstract
The withdrawal of property rights has not been addressed specifically so far. It has long been accepted that provided there is a willingness to neglect the good and physical detachment between the owner and the good, these conditions are sufficient to consider the good as res nullius. Nevertheless, the complex framework of the right to property, the diversity of objects upon which it falls and, above all, its social function shapes significantly the exercise of this right to withdraw property rights. Further, considering that this withdrawal cannot be made to the detriment of third people, the result is that in most of the cases the right to property can be regarded as a non-renounceable right.
