Resumen
La publificación de las aguas en los Derechos nacionales europeos no ha cesado de intensificarse
en las dos últimas décadas, en un proceso iniciado por la Ley alemana de 1976,
seguida por la española de 1985 y, más tarde, por la francesa de 1992 y la italiana de 1994.
Esta «convergencia» hunde sus raíces en las «cosas comunes» del Derecho romano, y en el
aprovechamiento ribereño subsiguiente, pero en las últimas décadas han contribuido a robustecerlo
la escasez del recurso y la necesidad de protegerlo. Esta misma «convergencia»
se extiende a la organización y la planificación: la cuenca se ha convertido en la base de la
organización administrativa, y la planificación en el instrumento de gestión de las aguas.

Abstract
In the last two decades, European national laws have increasingly emphasised the public
nature of water-right ownership, in a process of «publification» that began with the
German law of 1976, followed by the Spanish 1985 law, then the French one in 1992 and
the Italian in 1994. This convergence amongst national legislations is rooted in the Romanlaw
concept of res commune (common things) and the ensuing approach to waterside
usufruct. However, the scarcity of water has made this concept of communality more
robust as attempts are made to accord greater protection to this resource. This same
convergence can be seen in organisation and planning: the watershed has become the basis
of administrative organisation, and planning has become a key instrument in integrated
water management.
