Resumen
Este estudio versa sobre la segunda parte del gran proceso de descentralización que se
está desarrollando en el Estado español desde la Constitución de 1978. Si la primera fase
descentralizadora desarrolló, básicamente, el ámbito regional, la segunda tiene por finalidad
incrementar la autonomía de los municipios potenciando sus competencias con reducción
de las funciones del Estado y las comunidades regionales. En la misma línea se desautorizan los controles directos de éstos sobre los municipios. Así se desprende de las
propuestas contenidas en el Libro Blanco y en el Proyecto de Ley del Gobierno Local, que
este municipalismo extremoso intenta legitimar en una supuesta soberanía municipal. El
estudio se enmarca dentro de un contexto histórico y de Derecho comparado.

Abstract
This study turns the party of the second part of the great process of decentralization that
is developing in the Spanish Status from the Constitution of 1978 astride. If the first phase
of devolution developed, basically, the regional environment, the second have for purpose
to increase the autonomy of the municipalities empowering its competences with
drawdown of the functions of the Status and the regional communities. In the same line
the controlling interests are disapproven of these on the municipalities. He comes off this
way of the proposals contained in the White book and in the Bill of the Local government
that this radical conception of the local government tries to legalize in a municipal
supposed sovereignty. The study is framed inside a historical context and of comparative law.
