URBANISMO Y CORRUPCIÓN:. ALGUNAS REFLEXIONES DESDE. EL DERECHO ADMINISTRATIVO

Resumen
En los últimos meses, las portadas de los periódicos han tenido como protagonistas los escándalos
de corrupción ligados al urbanismo, con un enorme impacto ambiental y social.
Entre las causas de este fenómeno se señala la excesiva discrecionalidad con que los Ayuntamientos
han ejercido la función planificadora, pero del análisis de la legislación autonómica
se deduce que las Comunidades Autónomas ya cuentan con múltiples instrumentos
jurídicos para ejercer un control supramunicipal en aras de un desarrollo urbanístico sostenible,
y que allí donde no existen pueden establecerse por la legislación, tal y como se ha
hecho recientemente en Andalucía. En el nivel estatal, el Proyecto de Ley del Suelo, actualmente
en tramitación, introduce asimismo diversas medidas justificadas en el reconocimiento,
por fin, del suelo como un recurso «natural, escaso y no renovable».

Abstract
In recent months the front pages of newspapers have mentioned corruption scandals
linked to land planning that have an enormous social and environmental impact. Among
the causes of this phenomenon are highlighted the excessive discretional manner in which
the town councils have exercised their planning functions, but according to an analysis of
the autonomous legislation it appears that the Autonomous Communities have multiple
legal instruments with which they can exercise control over the municipalities in the
interests of urban development, and where they don’t exist they can be established by
legislation, as was recently done in Andalucia. At the state level, the Land Law proposal
currently being considered itself introduces several methods justified in the recognition,
finally, of the land as a «natural, scarce and non-renewable» resource.
