Interrelación entre el Derecho Constitucional y el Derecho Internacional de los Derechos Humanos

Resumen
Partiendo de una referencia a los principales paradigmas contemporáneos vinculados al tema a analizar, el autor estudia cómo fue en Latinoamérica el proceso de aproximación del Derecho Internacional de los Derechos Humanos con el Derecho Constitucional, desde la separación, pasando por las primeras formas de complementación, por la constitucionalización del primero y fusión actual sin que las normas pierdan su fuente jurídica. Se procura profundizar en el concepto de «bloque constitucional », «bloque constitucional de los derechos humanos» o «bloque de los derechos humanos» procurando evitar problemas terminológicos y aclarar su sentido. Por último, se analiza la compatibilidad de la noción del bloque de los derechos humanos con la Constitución uruguaya y cuál es la jurisprudencia actual de la Suprema Corte de Justicia.

Abstract
Considering the main paradigms of our days linking to the title of this paper, the author studies the approach process between the International Law of the Human Rights and the Constitutional Law, from the original separation, across the complementation period, the transformation of the international law in constitutional law, until their recent merger without the blending of their different sources. The paper deepens the concept of the «human rights block» trying to avoid terminological problems and clarifying its meaning. At the end, the author analyzes the compatibility of the notion of the «human rights block» with the Uruguayan Constitution and the current Supreme Court`s decisions.
