Resumen
La extensión y variedad que la legislación civil de las Comunidades Autónomas
tiene a la luz de las leyes aprobadas en los últimos quince años y,
sobre todo, la que pueden llegar a tener como resultado de las extralimitaciones
cometidas en las recientes leyes de reforma de los Estatutos de Autonomía,
supone una amenaza de desvertebración del Derecho civil español y
de la unidad de mercado. Es urgente retomar el debate acerca de la interpretación
que merece la expresión “desarrollo” utilizada por el artículo 149.1.8ª
de la Constitución, y es de desear que el Tribunal Constitucional ponga orden
y declare que no solamente es inconstitucional el artículo 129 del Estatuto
de Autonomía de Cataluña, así como cualquier normativa ordinaria
que en él trate de encontrar su amparo. Los excesos se advierten también, en
mayor o menor medida, en Aragón, Andalucía, Galicia, las Islas Baleares o
la Comunidad Valenciana.

Abstract
The extensión and variety of civil legislation approved by Autonomous
Communities during the latests fifteen years, and, in particular, the extension
and variety that it would be able to acquire thanks to oversteps contained
in the recent Statutes of Autonomy reform Acts, mean a serious threat
to the integriy of spanish civil law and the unity of the market. It is urgent
a new taking up of the debate about the word “desarrollo” (development)
placed in section 149.1.8ª of Spanish Constitution, and a judgement of unconstitutionality
would be very advisable, not only with regard of article
129 of Statute of Autonomy for Catalonia, but also regarding common catalonian
legislation whose competence is tried to be located on that section. It
would be likewise advisable to correct oversteps that are easy to find in Aragón,
Andalusia, Balear Islands or the Valencian Community.
