Resumen
La STC 48/2005 supone un giro muy relevante en la doctrina constitucional relativa a los
límites al legislador en la aprobación de leyes de caso único. Se introduce un nuevo parámetro
de control derivado del derecho fundamental a la tutela judicial efectiva del artículo
24 CE. Ya no se trata sólo de discernir sobre si las leyes singulares disminuyen el acceso a
la justicia y si esto está justificado en el caso concreto, sino si estas decisiones materialmente
administrativas adoptadas con rango de ley pueden ser controladas en cada caso
por el TC, con el mismo nivel de tutela material, con la misma intensidad que proporcionan
los jueces y tribunales cuando estas mismas decisiones son tomadas por la Administración.
Este nuevo parámetro constitucional puede llevar a reconocer un ámbito material
reservado a la Administración, al ejecutivo.

Abstract
The STC 48/2005 represents a relevant change in constitutional doctrine related to the
limits to the legislator when approving laws of unique case. It introduces a new parameter
of control derived from the fundamental right to the effective judicial protection of art. 24
CE (right to a fair trial). That is not only a question of distinction about whether the
singular laws decreases the access to Justice and whether it is justified in this case, but
whether these decisions, indeed administrative, adopted with rank of law may be
controlled in each case by the TC, with the same level of material protection, with the same
intensity that supplies judges and courts when these same decisions are proposed by the
Administration. This new constitutional parameter may yield to recognise a material scope
reserved to the Administration, to executive power.
