Las leyes de amnistía en el sistema europeo de derechos humanos. De la decisión de la Comisión en Dujardin y otros contra Francia a la sentencia de la Gran Sala en Marguš contra Croacia: ¿progresivo desarrollo o desarrollo circular?

Resumen
Este artículo analiza los pronunciamientos de los órganos del sistema europeo de protección de derechos humanos sobre las leyes de amnistía para graves violaciones a los derechos humanos. En el mismo se examina sistemáticamente la posición adoptada respecto a su compatibilidad con el Convenio Europeo de Derechos Humanos, desde la primera decisión de la Comisión Europea de Derechos Humanos, en el caso Dujardin y otros c. Francia, hasta la más reciente y aparentemente completa sentencia de la Gran Sala, en el caso Marguš c. Croacia. Todo ello, tratando de vincular y contextualizar cada una de las decisiones que se estudiarán tanto en visión comparada con otros sistemas regionales y con el sistema universal como en relación con el propio desarrollo del sistema europeo.

Abstract
This article analyses the decisions issued by the bodies of the European Human Rights System concerning the admissibility of amnesty laws in case of gross human rights violations. It aims at describing the position taken by the European bodies as to the compatibility of the amnesty laws with the European Convention on Human Rights, by thoroughly examining its jurisprudence from the first decision of the European Commission of Human Rights in the case Dujardin and others v. France, to the most recent judgment of the Grand Chamber in the case Marguš v. Croatia. In addition, this analysis points out the existing links between these decisions and both other regional Human Rights systems and the universal one, from a comparative perspective. Lastly, it aims at explaining this jurisprudence in the overall context of the development of the European system itself.
