Resumen
La denominada «acción concertada» para la prestación de servicios a las personas, configurada por el legislador como un nuevo instrumento jurídico de carácter no contractual que, en algunos casos, se reserva en favor de entidades de iniciativa social sin ánimo de lucro, ha desencadenado un amplio interés doctrinal y, a la vez, una notable conflictividad judicial. En el presente trabajo, a la vista del régimen jurídico al que la misma queda sujeta y de la jurisprudencia del TJUE y del TS, queda desvelada su auténtica naturaleza jurídica y se reflexiona sobre su efectivo alcance y funcionalidad para la organización y prestación de los servicios sociales.

Abstract
The so-called «concerted action» for the provision of services to individuals, established by the legislator as a new non-contractual legal instrument that, in some cases, is reserved for non-profit social initiative entities, has generated considerable scholarly interest and, at the same time, significant legal disputes. This paper, in light of the legal framework governing this action and the jurisprudence of the CJEU and the Spanish Supreme Court, reveals its true legal nature and reflects on its effective scope and functionality for the organization and provision of social services.
