El control de convencionalidad como instrumento para proteger derechos esenciales y prevenir la responsabilidad internacional del Estado

Resumen
Este trabajo enfocará principalmente el funcionamiento y la importancia del «control de convencionalidad» que deben efectuar los jueces y demás autoridades públicas internas para proteger adecuadamente los derechos humanos, honrar los compromisos internacionales en la materia y, entre otros objetivos, evitar que el Estado incurra en responsabilidad internacional. Semejante examen convencional requiere verificar la congruencia de las normas jurídicas internas que aquellos aplican en casos concretos con la Convención Americana sobre Derechos Humanos —entre otros instrumentos internacionales que integran el corpus iuris interamericano— y los estándares hermenéuticos forjados por la Corte Interamericana de Derechos Humanos en sus sentencias y opiniones consultivas.

Abstract
This paper mainly focuses on the operation and the importance of «conventionality control» to be performed by judges and other public authorities in the domestic sphere to adequately protect human rights, honor international commitments in this area and, among other objectives, avoid international responsibility of the State. Such conventional examination requires verifying the consistency of domestic legal rules (which those authorities apply in specific cases) with the American Convention on Human Rights, among other international instruments constituting the interamerican corpus juris, and hermeneutical standards developed by the Inter-American Court of Human Rights in its judgments and advisory opinions.
