Resumen
El texto analiza el control judicial que realiza la Corte Suprema de Chile en materia ambiental, destacando su papel en la protección de los humedales urbanos, esenciales para la biodiversidad y la mitigación de impactos ambientales en áreas urbanas. La Convención Ramsar ha sido clave en la protección jurídica de estos sitios, estableciendo estándares para su resguardo y uso racional de estos ecosistemas. La Corte ha desarrollado una jurisprudencia significativa, aplicando principios internacionales, considerando que el daño ambiental incluye criterios técnicos como duración, magnitud y capacidad de regeneración. Asimismo, la jurisprudencia analizada resalta el derecho constitucional a un medio ambiente libre de contaminación, expandiendo su interpretación para incluir la preservación de la naturaleza, en consonancia con los principios de precaución y desarrollo sustentable, enfoque que busca equilibrar derechos individuales con la protección colectiva del medio ambiente.

Abstract
The text analyzes the judicial oversight exercised by the Supreme Court of Chile in environmental matters, emphasizing its role in protecting urban wetlands, which are essential for biodiversity and mitigating environmental impacts in urban areas. The Ramsar Convention has played a foundational role in the legal protection of these sites, setting standards for their safeguarding and the rational use of these ecosystems. The Court has developed significant jurisprudence, applying international principles and considering environmental damage based on technical criteria such as duration, magnitude, and regenerative capacity. Moreover, the analyzed jurisprudence underscores the constitutional right to an environment free from contamination, expanding its interpretation to include the preservation of nature, in alignment with the precautionary principle and sustainable development—an approach that seeks to balance individual rights with the collective protection of the environment.
