Resumen
La sentencia Bosphorus Airways c. Irlanda marca una nueva etapa en
las relaciones entre el Derecho Comunitario y el CEDH. Con un solo movimiento, el
TEDH, por un lado, otorga al Derecho Comunitario un certificado de conformidad con el CEDH, por otro, somete al Derecho Comunitario al respeto del Convenio, aun cuando la Comunidad Europea no lo haya ratificado, al afirmar la competencia del TEDH para apreciar si éste presenta una «insuficiencia manifiesta» respecto del Convenio.

Abstract
The Bosphorus Airways v. Ireland ruling sets a new stage in the relations
between European Community Law an the ECtHR. With one move, on the one hand, it provide the European Community Law with a certificate of conformity with the ECtHR and on the other hand, it subordinates the European Community Law to the Convention, even though the Community has not ratified it, declaring the competence of the ECtHR over European Community Law to estimate if there is a «manifest deficiency» with regard to the Convention.
