Crónica de una adhesión anunciada: algunas notas sobre la negociación de la adhesión de la Unión Europea al Convenio Europeo de Derechos Humanos

Resumen
El artículo analiza algunos de los principales retos que se derivan de la adhesión de la UE al CEDH, proceso que se ha abierto oficialmente tras la reforma de la UE (Tratado de Lisboa) y del CEDH (Protocolo n.º 14). Entre estos retos destacan el respeto del reparto de competencias entre la UE y sus Estados miembros, el respeto del principio de autonomía del ordenamiento de la UE y la participación de la UE en los órganos de control del CEDH. El artículo expone e interpreta las gestiones realizadas hasta el momento, las posiciones defendidas desde la Comisión y el Parlamento Europeo, el mandato de negociación aprobado en la UE así como algunos de los principales obstáculos que quedan en el camino.

Abstract
The article discusses some key challenges arising from EU accession to the ECHR, a process that has been officially opened after EU reform (Lisbon Treaty) and the ECHR reform (Protocol n.º 14). These challenges include the respect for the division of competences between the EU and its Member States, the principle of autonomy of the EU and EU participation in the supervisory bodies of the ECHR. The article describes and interprets the steps taken so far, the positions taken by the Commission and the European Parliament, the negotiating directives approved in the EU and some of the major remaining obstacles on the road.
