El Tribunal Constitucional como «defensor de la foralidad»: comentario de la STC 118/2016, de 23 de junio, sobre el nuevo régimen impugnatorio de las normas forales fiscales

Resumen
La LO 1/2010 sometió las normas forales fiscales al control del Tribunal Constitucional y las sustrajo del conocimiento de la jurisdicción ordinaria. Este estudio analiza la sentencia en la que el Tribunal Constitucional declaró la constitucionalidad de la ley. La sentencia se basa en dos premisas: la habilitación constitucional del legislador orgánico para crear nuevos procesos constitucionales y la legitimidad constitucional del fin perseguido con ellos: la protección de la foralidad. El Tribunal rechaza las dos consistentes objeciones planteadas por los recurrentes: la prohibición constitucional de desfigurar los procesos constitucionales directamente establecidos por el constituyente (sin que se acepte que la creación formal de nuevos procesos pueda servir para eludir fraudulentamente dicha prohibición) y la ilegitimidad constitucional de la finalidad de la ley consistente en reducir el ámbito de la jurisdicción ordinaria y el alcance del derecho a la tutela judicial efectiva (sin que pueda aceptarse que dichos sacrificios se encuentren amparados por los derechos históricos de los territorios forales).

Abstract
The Organic Law 1/2010 submitted the fiscal Foral Regulations to the control of the Constitutional Court and not of the ordinary jurisdiction. This study analyzes the sentence in which the Constitutional Court declared the constitutionality of the law. The sentence is based on two premises: the constitutional empowerment of the organic legislator to create new constitutional processes and the constitutional legitimacy of the end pursued with them (the protection of historical rights). The Court rejects the two consistent objections raised by the appellants: the constitutional prohibition of changing the constitutional resources directly established by the constituent (without it being accepted that the formal creation of new resources may serve to fraudulently evade the prohibition) and the constitutional illegitimacy of the purpose of the law. The objective was to reduce the scope of due process. But it can not be accepted that the reform is protected by the historical rights of the foral territories.
