Reconfigurando la libertad de pensamiento ante el impacto de las neurotecnologías

Resumen
El artículo analiza la necesaria reconfiguración de la libertad de pensamiento ante el avance de las neurotecnologías que han superado la concepción de la mente como un reducto inviolable. Partiendo del debate sobre los neuroderechos y su evolución desde la libertad cognitiva hacia una interpretación adaptativa de la libertad de pensamiento reconocida en los tratados internacionales, se abordan su naturaleza absoluta y sus garantías negativas frente a la revelación, la penalización y la alteración del pensamiento. Desde ese marco se examinan las teorías del umbral y el enfoque cuasiabsoluto para evaluar los criterios de admisibilidad de las excepciones o limitaciones, proponiendo reafirmar su estatus absoluto interpretándolo como primacía axiológica y presunción iuris tantum de ilegitimidad de intervenciones.

Abstract
The article analyses the necessary redefinition of freedom of thought in light of neurotechnological advances that have rendered the concept of the mind as an inviolable stronghold obsolete. Starting with the neurorights debate and its evolution from cognitive freedom to an adaptive interpretation of freedom of thought recognised in international treaties, the paper addresses the absolute nature of freedom of thought and its negative guarantees against disclosure, criminalisation and alteration. Within this framework, threshold theories and the quasi-absolute approach are examined in order to evaluate the criteria for the admissibility of exceptions or limitations. The author proposes to reaffirm the absolute status of the right by interpreting it as axiological primacy and a rebuttable presumption of illegitimacy of interventions.
