Resumen
La gestación subrogada se configura como un contrato oneroso o gratuito, en virtud del cual una mujer aporta la gestación, o también su óvulo —según los casos—, comprometiéndose a entregar el nacido a los comitentes o padres de intención, que podrán aportar, o no, según los casos, sus gametos. La maternidad subrogada sigue siendo un hecho social controvertido que sigue provocando opiniones dispares, pero que afecta a derechos fundamentales de los sujetos (madre gestante y niños gestados) implicados. En este trabajo, se estudiará el tratamiento de la gestación subrogada en la jurisprudencia del Tribunal Supremo, del Tribunal Europeo de Derechos Humanos y en la reciente jurisprudencia del Tribunal Constitucional, con especial atención al voto particular emitido en materia de maternidad subrogada.

Abstract
Surrogacy is configured as an onerous or free contract, by virtue of which a woman provides the pregnancy, or also her egg —depending on the case—, committing to deliver the child to the intended parents or parents, who may or may not contribute, depending on the case, their gametes. Surrogacy continues to be a controversial social fact that continues to provoke disparate opinions, but it affects the fundamental rights of the subjects (gestational mother and gestated children) involved. In this work, the treatment of surrogacy in the jurisprudence of the Supreme Court of the European Court of Human Rights and the recent jurisprudence of the Constitutional Court will be studied, with special attention to the dissenting vote issued on surrogacy matters.
