Resumen
Este trabajo examina el contenido y alcance del derecho fundamental a la tutela judicial efectiva en el ámbito de las resoluciones relativas a los regímenes de comunicación, estancias y visitas dictadas en contextos de violencia de género, a la luz de las SSTC 115/2024 y 145/2024. El Tribunal Constitucional ha puesto de manifiesto que la violencia de género siempre lleva aparejada la vulneración de derechos fundamentales, por lo que la mera existencia de indicios fundados de dicha violencia genera un deber reforzado de motivación que exige a los órganos judiciales un mayor esfuerzo en la fundamentación de sus resoluciones. La utilización de razonamientos estereotipados y la omisión del contexto de violencia de género no cumplen con el deber de motivación reforzada y, por tanto, vulneran la tutela judicial efectiva. De este modo, la motivación judicial se configura como una garantía sustantiva frente a la arbitrariedad y como un instrumento esencial de protección de los derechos fundamentales.

Abstract
This paper examines the doctrine of effective judicial protection in the context of decisions relating to child contact arrangements in cases of gender-based violence, with reference to Constitutional Court Judgments 115/2024 and 145/2024. The Constitutional Court has made it clear that gender-based violence always entails the infringement of fundamental rights and, therefore, the existence of reasonable reasons to believe that such violence exists gives rise to a reinforced duty of reasoning that requires judicial bodies to make a greater effort in substantiating their decisions. The use of stereotypical reasoning and the omission of the context of gender-based violence do not comply with that duty of reinforced reasoning and, therefore, are in breach of the right to effective judicial protection. Judicial reasoning is thus configured as a substantive guarantee against arbitrariness and as an essential instrument for the protection of fundamental rights.
