Resumen
Este artículo expone y analiza los aspectos centrales de la relación histórica y actual de la jurisdicción interamericana de derechos humanos y los Estados parte en la Convención Americana de esta materia, de 1969, especialmente aquellos que han reconocido la competencia contenciosa de la Corte Interamericana. En este sentido, se describe el avance en la atención a los derechos humanos en el área geopolítica correspondiente, en la medida en que opera el restablecimiento o el desarrollo de la democracia. Asimismo, se alude a los llamados «actores» del Sistema (Interamericano: Estados nacionales, Organización de los Estados Americanos, sociedad civil y «actores emergentes» (ombudsman, defensoría pública, comunicadores sociales, academia). También se examinan las vertientes de competencia de la Corte Interamericana y la eficacia (vinculante o no) de sus determinaciones. Este trabajo da cuenta de la recepción nacional del Derecho Internacional de los Derechos Humanos por diferentes vías: reformas constitucionales, leyes de «implementación», políticas públicas y decisiones jurisdiccionales. A este último respecto se analiza el avance del denominado «control de convencionalidad», que ha adquirido notable importancia en la práctica judicial latinoamericana y constituye un factor relevante para la formación del jus commune en esta región.

Abstract
This article expounds and analyzes the key aspects of the historical and presentday relationship between Inter-American Human Rights jurisdiction and the States Parties to the 1969 American Convention on Human Rights, especially those that have recognized the contentious jurisdiction of the Inter-American Court. In view of this, a description is given of the progress made in observing human rights in the corresponding geo-political area according to the degree to which democracy has been restored or has progressed. Mention is also made of the so-called «actors» of the Inter-American system: national States, the Organization of American States, civil society and «emerging actors» (ombudsman, public advocates, social communicators and academia). Certain aspects of the Inter-American Court and the (binding or non-binding) effectiveness of its decisions are also examined. This paper discusses national responses to international human rights law through various means: constitutional reforms, «implementation» laws, public policies and judicial decisions. This last point analyzes the progress of the so-called «conventionality control», which that has gained considerable importance in the Latin American judicial practices and is a significant factor in the establishment of ius commune in the region.
