Resumen
La figura del interés legítimo ha sido cuestionada en los últimos años, habiéndose roto el aparente consenso que existía sobre su definición. Este trabajo ofrece un concepto de interés legítimo basado en el derecho histórico, que se aleja de su contraposición con la figura del derecho subjetivo, para centrarse en la operativa diferenciada del interés legítimo respecto de los derechos preexistentes de los ciudadanos afectados por la actuación administrativa.

Abstract
The category of legitimate interest has been questioned in recent years, after the apparent consensus that existed on its definition was broken. This work suggests a concept of legitimate interest based on historical Law, which moves away from its opposition to the figure of subjective law, to focus on the differentiated operation of legitimate interest with respect to the pre-existing rights of citizens affected by administrative action.
